Islam
aims at strengthening the institution of marriage. The right of divorce
is given but only in exceptional circumstances. It is important to safeguard
the best interests of women and children as well as peace within the family.
Various Muslim societies around the world are following different methods
of divorce. Making divorce valid through pronouncing ‘Talaq’ three times
in one instance has created huge injustice to women in many Muslim societies.
The wife is also entitled to seek divorce from her side with eventual
consent of the husband (khula) or by dissolution of the marriage through
a judicial order (faskh). The parties may also divorce each other by mutual
aversion and consent (mubarat). This research paper will identify differences
between various schools of thoughts and generate a formula which ensures
adequate protection to women as well as justice to men in light of Quranic
teachings. Ultimately, through analysis of all issues, a uniform process
should be established based on justice and peace im Muslim societies throughout
the world.
The
paper will also include issues related to Mehar (alimony). Various
practices are followed in various societies. At times, alimony is to be
given at the time of Nikah, while some delay it to the time of divorce.
The amount of alimony is also under question as many girls or their parents
are made to forego Maher or keep a minimal amount in the name
of Islamic morality, thus compromising on the security of the bride.
The research papers should address all issues and suggest a solution so
as to ensure justice to all parties, that is the wife, children and husband.
